Catherine McDowell Lesson

Acknowledges and agrees as follows:

1. I have requested, and Catherine Cox (Cath) has agreed to provide me with, equestrian tuition and advice (Services) in relation to a third-party operator for the purposes of equestrian services (clinician) at this property Winterwood Farm, Glanmire.
2. The Services from the clinician may be provided at a place and at a time arranged by Cath, the clinician and the participant.
3. I acknowledge that equestrian activities are dangerous and can cause personal injury, including death, and can cause damage to property.
4. During the provision of Services by the clinician, where it involves contact with a horse, particularly riding, I agree to use any safety equipment including a helmet and riding boots, in accordance with the Australian Standards or the recommendation by Equestrian Australia as per latest requirements.
5. I understand that both Cath and the clinician will organise clinics, lessons, and other activities (equestrian or otherwise) with due care and attention.
6. I acknowledge and agree that I participate in this clinic and/or lessons, and any other equestrian activity involving services of Cath or the clinician, at my own risk and I agree that, to the fullest extent permitted by law, Cath nor the clinician will be liable to me for any loss, cost, damage or expense (Loss) caused directly or indirectly by either Cath, parties associated with Winterwood, or horses, whether such Loss arises from the negligence of Cath, the clinician, or aforementioned parties or otherwise.
7. I agree to indemnify and hold harmless Cath, the clinician, Winterwood Farm, McDowells Herbal Pty Ltd and its subsidiaries against any loss they or either of them incur from a claim against either of them by a third party arising out of my conduct at any clinic or other activity, whether such claim arises out of my negligence or otherwise.
